What Services Does Knower™ Care Center Provide?
Knower™ Care Center provides remote health and wellness services (Tele- and Video-consultation and Tele-assistance) through doctors, nurses and other health professionals, also providing face-to-face and home-based Services through a network of trusted partners.
Consent for Face-to-Face Care
You consent and authorize health care professionals with whom you interact through Knower™ Care Center ("Application" and "Website") to provide routine medical, health care and treatment, such as physical examinations, procedures to diagnose or treat illnesses and injuries, and/or make necessary referrals.
General Terms and Conditions
By accessing or using the Services, you agree to be bound by this Agreement, on the terms published and accessible through our Application or our website at the time of your access or use, and you agree to use the Services in accordance with the terms and conditions of this Agreement, our Privacy Policy (www.knower.pt) and any additional terms and conditions that are referenced herein or that may apply to specific features of the Services, or to products or services that we make available through the Services (all of which are considered part of this Agreement). If you do not agree to the terms and conditions of use of the Services set forth in this Agreement, you shall not use the Services.
The Company reserves the right to change, without prior notice, the conditions of use or other procedures published on the Platform, for which reason the user should regularly consult these terms and conditions, the conditions of use or other procedures, given that regular and continued use of this website implies unreserved acceptance of the changes made to them and subjection to the most recent version.
Specific Terms and Conditions of the Video-Consultation and Teleconsultation Service
The Video-consultation and Teleconsultation services aim to increase the accessibility to an adequate medical opinion, as an alternative and complementary service, not intended to replace the normal hospital or family health services.
The information and advice provided by our health care professionals should be used to obtain the diagnosis possible from a distance, to increase the Patient's knowledge of their medical situation and what are the best options with which to continue their routine health care. Knower™ Care Center recommends that the Patient discuss the information received with the attending physician especially when the advice is significantly different from the care that has been prescribed by the attending physician.
The information and advice given by the health professionals providing the service is based on the information the patient gives them. It is therefore the responsibility of the patient to ensure that this information is correct and complete. The patient cannot hold any party involved in the care process responsible if the information they have provided, intentionally or unintentionally, is incorrect and has influenced the medical decision.
It is the patient's right and obligation, in the event of any doubts arising during treatment, to ask the healthcare professional for a full explanation of the situation.
Professionals or Knower™ Care Center are prohibited from selling any type of medical or insurance products. Advice given by professionals during a service is based on their professional experience and good clinical practice.
The doctors providing the service may, in their high clinical discretion, prescribe medication. Knower™ Care Center may subcontract the provision of these services to third parties.
The EAS recommends the Patient to share with their treating physician any medication changes suggested by the providing physician.
It is the User's strict responsibility to comply with the instructions, dosages, taking of the prescribed medication as well as to warn of possible side effects experienced.
The service providing doctors may, at their high clinical discretion, prescribe Complementary Diagnostic and Therapeutic Means.
Without prejudice to what is established in the Privacy Policy, the Patients' personal data will be registered in individual Clinical Records, which will be kept in a secure area. These data will be treated in a strictly confidential manner and will not be provided to third parties without the express consent of the Patient unless required by legal or judicial bodies.
Under express authorisation from the Patient, the information collected may be made available to their treating doctor.
Specific Terms and Conditions for Home Healthcare Services
Provision of home health care through Knower™ Care Center Partners, allowing the User, by electronic or telephone means, to access such care under the terms and conditions described herein.
The booking of services must be made by Users aged 18 (eighteen) or over (individuals under this age must have the authorisation of their representatives). The elements and information transmitted by the User shall enjoy full legal effects, recognising the User and their purchases, the User not being able to allege the lack of signature for non-compliance with the obligations assumed. We also reserve the right to refuse service to any person for any reason and at any time.
All services are always subject to local availability.
Appointments may be requested by telephone or other means of contact. If the User is not yet a Client, it will be necessary to create a client registration and enter the data on the Platform. User and Patient data may be supplied by telephone or submitted electronically by the Client. The User/Client may be the patient themselves or a person responsible for them.
Right of Use of the Contents Provided by the User
We may, in our sole discretion, allow you to post or submit content and other materials through the Services (collectively, "User Provided Content"). You grant us, Knower™ Care Center and any person authorized by us, a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, unrestricted license to use, copy, modify, transmit, sell, exploit, distribute, publicly display or present and/or create derivative works of such User Provided Content, in whole or in part, in any form or by any means (whether now known or hereafter developed), for any purposes we choose. You also grant us, Knower™ Care Center and any person authorized by us, the right to identify you as the author of any Provided Content you submit.
User shall receive no compensation of any kind for any use of the Provided Content that User submits. You acknowledge that Knower™ Care Center acts only as a passive vehicle for distribution of User Provided Content and is not responsible or liable to you or any third party for the content or accuracy of User Provided Content. You understand that we are under no obligation to monitor the areas of the Services through which users may post User Provided Content. However, we reserve the right at any time, in our sole discretion, to examine User Provided Content and edit, move, delete and/or refuse to accept any User Provided Content that we feel violates this Agreement or is otherwise unacceptable or inappropriate for legal or other reasons.
Any use of the Provided Content by you is entirely at your own risk. You represent and warrant that all Provided Content that you post or transmit will be original, that you will not copy the work of others or infringe any third party's intellectual property rights, rights of privacy or rights of publicity, and that such content will not contain any defamatory or disparaging statements. You further represent and warrant that you have the right to grant the license described above. You agree to indemnify and hold harmless Knower™ Care Center, its subsidiaries, and all of their respective officers, directors, managers, employees, shareholders, agents, representatives, licensors, successors and assigns from and against any and all losses, expenses, damages and costs, including reasonable attorneys' fees arising out of any User Provided Content that is posted or transmitted through the Services by you or any third party accessing your account.
Payment
Registration with the Knower™ Care Center is free. You will only be charged for the Services, depending on their type and according to the prices in force. For this purpose, the User must choose one of the available payment methods (ATM or credit card).
We do not currently handle any insurance claims, nor will health care professionals handle such claims on your behalf. Although the consultations/treatments you receive from health care professionals through the Application may or may not be covered by your insurance, it is your sole responsibility to contact your health insurance carrier, verify applicable coverage, and submit a claim to the insurer. You are responsible for paying the full fee (and for paying it in advance), regardless of whether you may later receive a reimbursement from your insurer for all or part of the costs.
Intellectual Property
Knower™ Care Center, exclusively (and its licensors, where applicable), owns and will hold all right, title and interest, including all intellectual property rights, in and to the Services and any suggestions, ideas, enhancement requests, feedback, recommendations and other information provided by you or any other party relating to the Services. Any copy, modification, revision, improvement, adaptation, translation or work derived or created from the Services shall be owned solely and exclusively by Knower™ Care Center and/or, where applicable, Knower™ Care Center's third party suppliers, as well as any and all patent rights, copyrights, trade secret rights, trademark rights and all other proprietary rights throughout the world, and you agree to assign to Knower™ Care Center any and all rights, title or interest of yours in the Services or any modification or derivative work of the Services. You will not remove (nor will you authorize or permit a third party to remove) the legend of any proprietary rights in the Services.
This Agreement does not constitute a sale nor does it convey to you any ownership rights in or relating to the Services, or any intellectual property rights owned by Knower™ Care Center. The Knower™ Care Center name and logo, and product names and logos associated with the Services, are trademarks of Knower™ Care Center, its affiliated companies or third parties, and no license to use them will be granted.
The materials appearing in the Services are protected by copyrights held by Knower™ Care Center and/or other applicable rights holders. You may download and reprint a single copy of the materials from the Services and solely for your personal, non-commercial use, provided that you keep intact all credits and copyright and other proprietary notices. Any other use of the materials without the prior written consent of Knower™ Care Center and the applicable rights holders is strictly prohibited.
Disclaimer
The Services and any information contained in or made available through them are provided on an "as is" basis. Access to and use of the Services is voluntary. We will consider all access or use as voluntary and entirely at your own risk.

We do not control, provide, endorse, warrant or guarantee any information, products, services or merchandising provided by health care professionals with whom you may interact through the Services. We also do not warrant or guarantee that files that may be available for download through the Services are free of infection or viruses, worms, trojans or other codes that contain contaminating or destructive properties.
We, and our technology service providers, cannot and do not guarantee the absence of errors, omissions, delays, interruptions or losses, including loss of data. You use the Services entirely at your own risk and you will be solely responsible for any damage to your hardware devices or loss of data that results from the download or use of the Services. Users of the Services are responsible for maintaining a means external to the Services for the reconstruction of any lost data.

WE DO NOT WARRANT OR GUARANTEE THE TRUTHFULNESS, ACCURACY, COMPLETENESS, TIMELINESS, OR USEFULNESS OF INFORMATION, PRODUCTS, SERVICES, MERCHANDISE, OR OTHER MATERIALS PROVIDED THROUGH THE SERVICES OR THE INTERNET GENERALLY. WE DO NOT WARRANT OR GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KNOWER™ CARE CENTER BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, PUNITIVE, EXEMPLARY, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES (WHETHER IN CONTRACT, TORT - INCLUDING NEGLIGENCE - OR OTHERWISE) ARISING OUT OF THIS AGREEMENT, OR THE USE OF (OR INABILITY TO USE) THE SERVICES, INCLUDING, WITHOUT LIMITATION, ANY INFORMATION OR DATA MADE AVAILABLE THROUGH THE SERVICES OR ANY SERVICES PROVIDED BY ANY HEALTH CARE PROFESSIONAL YOU INTERACT WITH THROUGH THE SERVICES (INCLUDING MEDICAL MALPRACTICE CLAIMS AGAINST SUCH PROFESSIONALS), EVEN IF WE ARE ADVISED IN ADVANCE OF THE POSSIBILITY OF SUCH DAMAGES. IN THE EVENT THE FOREGOING LIMITATION OF LIABILITY IS HELD UNENFORCEABLE BY A COURT OF COMPETENT JURISDICTION, KNOWER™ CARE CENTER'S MAXIMUM LIABILITY FOR ALL CLAIMS OF ANY KIND ARISING UNDER THIS AGREEMENT (WHETHER IN CONTRACT, TORT - INCLUDING NEGLIGENCE AND MEDICAL MALPRACTICE - OR OTHERWISE) SHALL NOT EXCEED THE AMOUNT PAID FOR THE RELEVANT SERVICE. THE FOREGOING LIMITATION OF LIABILITY SHALL COVER, WITHOUT LIMITATION, ANY TECHNICAL MALFUNCTION, COMPUTER ERROR OR LOSS OF DATA, AND ANY OTHER LOSS ARISING FROM THE USE OF THE SERVICES.
Compensation
You agree to indemnify and hold harmless Knower™ Care Center, its subsidiaries, and all of their respective officers, directors, managers, employees, shareholders, agents, representatives, licensors, successors and assigns from and against any and all losses, expenses, damages and costs, including reasonable attorneys' fees arising out of your use of the Services, your violation of this Agreement by you or anyone else using your account, or your violation of any rights of a third party. We reserve the right to control the defence of any proceeding for which we are entitled to indemnification under this section. In such a case, you agree to cooperate with us to the extent reasonably requested by us.
Modification or Discontinuation of the Services
We reserve the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Services or any part thereof, with or without notice. You agree that we will not be liable to you or to any third party for any modification, suspension or discontinuance of the Services or any part thereof.
Privacy
Your use of the Services is subject to the Knower™ Privacy Policy. Please read this policy to learn what information we collect through the Services, how we use it, how we protect it, and in what situations we may share it.
Miscellaneous provisions
This Agreement constitutes the entire agreement between Knower™ Care Center and you regarding the subject matter contained in this Agreement and supersedes all prior and contemporaneous agreements, proposals and communications, written or oral, relating to such subject matter. You may also be subject to additional terms and conditions that may apply when using third party products or services that are made available through the Services. In the event of a conflict between such third party's terms and conditions and this Agreement, this Agreement shall prevail.
This Agreement is personal to you and you may not assign it to any third party. If any provision of this Agreement is held to be illegal, invalid or for any reason unenforceable, that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of the remaining provisions. This Agreement is not intended to benefit any third party and does not create any third party beneficiaries. In fact, this Agreement may only be invoked or enforced by Knower™ Care Center or you. Any and all provisions of this Agreement that may reasonably be expected to apply after termination or expiration of this Agreement shall survive and apply after such termination or expiration, including, without limitation, provisions relating to ownership, indemnification, limitation of liability and applicable law.
You agree not to use the website for purposes that are unlawful or prohibited by these terms of use and current legislation.
Partial Invalidity
If for any reason or to any extent any provision of the Terms and Conditions is held to be invalid or unenforceable, such invalidity or unenforceability shall not in any way affect the validity of the other provisions of the Terms and Conditions and the enforcement of such provision shall be in accordance with Portuguese law.
Law and Jurisdiction
These Terms and Conditions are governed by the laws of Portugal and shall be interpreted in accordance with the Portuguese courts. The Portuguese courts shall have exclusive jurisdiction to settle any suit or dispute which may arise out of or in connection with these Terms and Conditions.
